I. Policy: Forever Warranty™ Mattresses Limited Warranty Policy

If your purchase was made prior to the effective date, please contact our Customer Support team via email at support@dreamcloudsleep.com or by phone at 1-888-863-2827 to review the warranty details of your product.APPLICABLE PRODUCT(S): ALL DREAMCLOUD SLEEP MATTRESSES SOLD THROUGH DREAMCLOUDSLEEP.COM AND AUTHORIZED RESELLERS, subject to all the terms and conditions below.

II. Warranty Coverage – Limited Warranty Terms

All DreamCloud Sleep products are covered by a trial period that allows you to return your purchased product to us if you are not satisfied. Learn about our trial policies here.

III. Who is Covered

This Limited Warranty is valid only for the original purchaser from the original purchase date of the mattress and is non-transferable. The “original purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the DreamCloud Sleep mattress from DreamCloud Sleep or a DreamCloud Sleep-authorized retailer. Please retain a copy of your receipt as proof of purchase and ownership. If you sell or otherwise relinquish ownership of the mattress to another person, this Limited Warranty terminates and the subsequent owner accepts the product “as is” and “with all faults.”

IV. What is Warranted

This Limited Warranty extends to applicable DreamCloud Sleep mattresses sold by DreamCloud Sleep and purchased directly from DreamCloud Sleep or DreamCloud Sleep’s authorized retailers (the “Mattress”). DreamCloud Sleep warrants the Mattress in its original packaging sold to you against the defects in material and workmanship set forth below (“Defects”) for a period of one (1) full year of ownership and use by you commencing from the time your Mattress is delivered to you. Under this Limited Warranty, a replaced Mattress is subject to the same Limited Warranty term as the original Mattress. For example, if you obtain a replaced Mattress, the Warranty term of the replaced Mattress begins from the date of delivery of the original Mattress. Products must be physically located in the contiguous United States, Alaska, and Hawaii to be eligible for return and/or warranty claims. Mattresses sold in a bundle are covered by this Limited Warranty. All other non-mattress Products (furniture and bedding) sold in a bundle along with a Mattress are covered by separate Furniture Warranty and Bedding Warranty.

V. The Following Defects Are Covered

  • Deterioration causing the Mattress to have a visible indentation greater than one and one half inches (1.5”) that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or bed base. Normal wear requires that a Mattress be continuously supported by a matching foundation or adjustable bed base with a proper bed frame sufficient to support the collective weight of the Mattress and any user(s).
  • Any physical flaw in the Mattress that causes the foam material to evidence degradation, split or crack, despite normal usage and proper handling.
  • Any manufacturing defect in the assembly of the Mattress cover.

VI. This Limited Warranty Does Not Cover

  • Any Mattress that has had the cover removed for any reason (removing the Mattress cover will void this warranty);
  • Any damage to the Mattress due to environmental causes;
  • Any Mattress which has been subject to misuse, neglect, accident or used in violation of instructions, including, without limitation, instructions to place the Mattress on a proper bed frame;
  • A normal increase in softness of the foam pressure-relieving material which does not affect the pressure-relieving qualities of the Mattress;
  • Comfort preference; Defects caused by physical abuse or damage to the structure and/or cover material of the Mattress, including, without limitation, burns, cuts, tears, liquid damage, or stains;
  • Mattresses sold “as-is”, “preconditioned”, “reconditioned”, “used”, “returned”, “previously owned”, or any other similar wording indicating that the Mattress is not “new” or of “first quality”, or has previously been purchased or used by another consumer, unless otherwise required by applicable law; and,
  • Any shipment of replacement DreamCloud Sleep mattresses outside of the contiguous United States, Alaska, and Hawaii.

VII. Warranty Remedy

In the event of a Defect (as defined above), DreamCloud Sleep’s sole liability and your sole remedies under this Limited Warranty will be:

  • For the first 10 years of ownership, we will replace your Mattress with a brand new DreamCloud Sleep mattress of equal or greater value at absolutely no charge to you; pursuant to our Return Request process.
  • In years 10+ DreamCloud Sleep will completely repair and re-cover your Mattress, or (pursuant to our Return Request process) replace your Mattress, at DreamCloud Sleep’s option. The only charge you will incur will be a transportation costs of $50 each way, which charges will be waived if a Defect is confirmed to exist by DreamCloud Sleep.

VIII. Your Responsibilities

In order for this Warranty to apply, the Mattress must be used on a firm, solid-surface, such as a bed base that is structurally capable of supporting the weight of the Mattress and user(s) for the entirety of its use.You must return your Mattress or Mattress Cover and show proof of original purchase. In years 10+, you will be responsible for a $50 shipping fee, each way, associated with shipping replaced or repaired Mattress. This fee will be waived upon DreamCloud Sleep’s confirmation of a Defect in materials or workmanship. At DreamCloud Sleep’s option, we may authorize you to provide photo evidence of defect in lieu of returning the Mattress.

X. Warranty Limitations, Disclaimers, and Limitation or Liability

IMPLIED WARRANTIES, INCLUDING ANY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IMPOSED ON THE SALE OF A DREAMCLOUD SLEEP MATTRESS AND ITS PARTS UNDER STATE LAW, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD AND NO WARRANTIES APPLY AFTER THAT PERIOD. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.NO OTHER EXPRESS WARRANTY HAS BEEN MADE OR WILL BE MADE ON BEHALF OF DREAMCLOUD SLEEP WITH RESPECT TO THE MATTRESS AND ITS PARTS, OR THE OPERATION, OR REPLACEMENT THEREOF. Some states do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may not apply to you.IF YOU USE AN INAPPROPRIATE FOUNDATION OR BOX SPRING WITH THE MATTRESS, SUCH USE WILL VOID THESE LIMITED WARRANTIES. DREAMCLOUD SLEEP RESERVES ALL RIGHTS TO DISCONTINUE ITEMS AND CHANGE PRODUCT SPECIFICATIONS WITHOUT NOTICE.DreamCloud Sleep does not warrant that the mattress is suitable for any person’s medical condition. DreamCloud Sleep makes no warranty beyond that which is contained in this Limited Warranty.

XI. Jury Waiver and Class Waiver

You agree that you are giving up your right to a jury trial, and that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative basis. You agree to waive participation in a class action. Our dispute resolution process (“DRP”) can be found at www.dreamcloudsleep.com/p/drp. You acknowledge that you had the ability to review the DRP prior to purchase, and that you are bound thereby even if you have not read it.

XII. Governing Law:

This Limited Warranty will be governed by the laws of the State of Florida.

Bedding 1-Year Warranty

WARRANTY COVERAGE – ONE (1) YEAR LIMITED WARRANTY TERMS:

Your new DreamCloud Sleep bedding is covered by a Limited DreamCloud Sleep Warranty (the “Limited Warranty”) for a period of One (1) full years from the date of delivery.

This Limited Warranty is valid only for the original purchaser from the original purchase date of the DreamCloud Sleep bedding and is non-transferable. The “original purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the DreamCloud Sleep bedding from DreamCloud Sleep or a DreamCloud Sleep-authorized retailer. Under this Limited Warranty, a replaced Bedding Product is subject to the same Limited Warranty term as the original Bedding Product. For example, if you obtain a replacement Bedding Product, the Warranty term of the replacement Bedding Product begins from the date of delivery of the original Bedding Product. Products must be physically located in the contiguous United States, Alaska, and Hawaii to be eligible for return and/or warranty claims. Bedding Products sold in a bundle are covered by this Limited Warranty. All other products (mattresses and furniture) sold in a bundle along with Bedding Products are covered by separate Mattress Warranty and Furniture Warranty.

V. The Following Defects Are Covered

This Limited Warranty applies to manufacturing Defects due to faulty workmanship or materials, subject to the limitations described in this warranty.

VI. This Limited Warranty Does Not Cover

  • This Limited Warranty does not apply to and is otherwise invalid as to the following, without limitation:
  • Normal wear and tear;
  • Normal soiling from everyday use or any condition resulting from incorrect or inadequate maintenance, cleaning, or care;
  • Use for commercial, institutional, or rental purposes;
  • Damage caused by structural problems or appliance malfunctions;
  • Damage caused by or related to fire, smoke, natural disasters, flood, theft, vandalism or other crimes, acts of God, or any other loss that is covered under an insurance policy;
  • Damage caused by extraordinary use;
  • Damage occurring during moves between residences or while in storage;
  • Any Bedding Product which has been subject to misuse, abuse, neglect, accident or used in violation of instructions; or,
  • Bedding Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “returned”, “previously owned”, or any other similar wording indicating that the Bedding Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

VII. Warranty Remedy

In the event of a Defect (as defined above), DreamCloud Sleep’s sole liability and your sole remedy under this Limited Warranty will be replacement of the applicable Bedding Product pursuant to our Return Request process.

This fee will be waived upon DreamCloud Sleep’s confirmation of a Defect in materials or workmanship. All care and laundry instructions accompanying Bedding Products must be followed at all times and failure to follow may void this Limited Warranty.

DreamCloud Sleep furniture is covered by a Limited DreamCloud Sleep Warranty (the “Limited Warranty”) for a period of two (2) full years from the date of delivery.

III. Who is Covered

This Limited Warranty is valid only for the original purchaser from the original purchase date of the DreamCloud Sleep furniture and is non-transferable. The “original purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the DreamCloud Sleep furniture from DreamCloud Sleep or a DreamCloud Sleep-authorized retailer. Please retain a copy of your receipt as proof of purchase and ownership. If you sell or otherwise relinquish ownership of the DreamCloud Sleep furniture to another person, this Limited Warranty terminates and the subsequent owner accepts the product “as is” and “with all faults.”

Under this Limited Warranty, a replaced item of Furniture is subject to the same Limited Warranty term as the original item of Furniture. For example, if you obtain a replaced item of Furniture, the Limited Warranty term of the replaced Furniture begins from the date of delivery of the original Furniture. Products must be physically located in the contiguous United States, Alaska, and Hawaii to be eligible for return and/or warranty claims. Furniture sold in a bundle are covered by this Limited Warranty. All other non-Furniture products (mattresses and bedding) sold in a bundle along with Furniture are covered by separate Mattress Warranty and Bedding Warranty.

DREAMCLOUD SLEEP SHALL NOT BE LIABLE UNDER ANY EXTENDED OR ADDITIONAL WARRANTIES OFFERED BY ANY RETAILER OR THROUGH A THIRD-PARTY UNDER ANY CIRCUMSTANCES.THE TERMS AND CONDITIONS STATED IN THIS LIMITED WARRANTY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY IN THE EVENT OF A MANUFACTURING DEFECT DURING THE WARRANTY PERIOD. IN NO EVENT SHALL DREAMCLOUD SLEEP BE RESPONSIBLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR SIMILAR DAMAGES, WHETHER INDIRECT OR DIRECT, AND WHETHER ARISING IN CONTRACT OR TORT.IN NO EVENT SHALL DREAMCLOUD SLEEP’S HAVE ANY RESPONSIBILITY OTHER THAN TO REPLACE OR REPAIR THE FURNITURE. IN NO EVENT SHALL DREAMCLOUD SLEEP’S RESPONSIBILITY EXCEED THE PURCHASE PRICE OF THE FURNITURE OR ITS REPLACEMENT. THIS EXCLUSIVE REMEDY SHALL NOT BE DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE SO LONG AS DREAMCLOUD SLEEP IS WILLING AND ABLE TO REPLACE ANY FURNITURE FOUND, UPON REVIEW OR EXAMINATION BY AN AUTHORIZED REPRESENTATIVE OF DREAMCLOUD SLEEP, TO CONTAIN A MATERIAL MANUFACTURING DEFECT DURING THE LIMITED WARRANTY PERIOD. Some states do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may not apply to you.DreamCloud Sleep does not warrant that any Furniture is suitable for any person’s medical condition. DreamCloud Sleep makes no warranty beyond that which is contained in this Limited Warranty.

XI. Jury Waiver and Class Waiver

You agree that you are giving up your right to a jury trial, and that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative basis. You agree to waive participation in a class action. Our dispute resolution process (“DRP”) can be found at www.dreamcloudsleep.com/p/drp. You acknowledge that you had the ability to review the DRP prior to purchase, and that you are bound thereby even if you have not read it.

XII. Governing Law

This Limited Warranty will be governed by the laws of the State of Florida.
